General Terms of Sale

These Terms of Sale apply to all sales concluded by the association LIBERTY ARTS FRANCE with its purchasing Customers.

 

LIBERTY ARTS FRANCE may adapt or modify these General Terms of Sale at any time. The applicable General Terms of Sale are those in force on the day of the order submitted by the Customer.

 

 

1 – DESCRIPTION OF THE SERVICES

The courses or workshops on drawing, painting and all others as described on the website of Liberty Arts are based on teaching methods adapted to the current reality.



2 – MATERIALS

Materials are provided for the lessons for children, teenagers or adults.
This does not apply in case you paint on canvas, as the canvas remains your responsibility for reasons of size, thickness, brand and quality.



3 – PAYMENT

Courses have to be paid before the start of the session in order to ensure the availability of the place.



4 – ABSENCES

For a regular session of 5 lessons, which take place on an ongoing basis, a maximum of one absence per 5 lessons will be accepted provided that the lessons to be recovered are attended within a maximum of 10 weeks from the date of the beginning of the session. A suspension of the course for a maximum of one consecutive month may be obtained upon written request specifying the reason for such a suspension.



5 – ASSIGNMENT OF COURSES OR WORKSHOPS

Courses or workshops cannot be transferred to another person.



6 – STORAGE AND RECOVERY OF STUDENT WORK

Works in progress, left on site, have to be identified in a clear manner and stored in the appropriate locations. Once completed they have to be picked up within a reasonable time. Otherwise, Liberty Arts may dispose of them at will or charge administration and storage fees that the student will be required to pay in order to recover them.



7 – STORAGE AND RECOVERY OF EQUIPMENT

The equipment lent on site has to be cleaned and stored in appropriate locations. Only canvases and papers used for works in progress may be left on site.

Concerning the material provided by you. Such material has to be recovered when the student expects not to renew his/her attendance at the end of a session or when he/she foresees to be absent for a period longer than one month. Otherwise, Liberty Arts may dispose of them at will or charge administration and storage fees that the student will be required to pay in order to recover them.



8 – LICENSE TO USE COPYRIGHTS AND IMAGE RIGHTS

Express written indication with parental permission for minors and minors themselves:

8.1 The student authorizes, free of charge, Liberty Arts to exhibit his/her work in the premises of the Espace Art et Culture in Antibes or elsewhere for a period to be determined with the student.
8.2 Moreover, the student grants without any time and space limitation and at no cost, a license authorizing Liberty Arts to reproduce, distribute copies on any medium including Internet (website, social networks…) for the purpose of promoting Liberty Arts or the student or for any other non-commercial purpose.
8.3 The student authorizes, free of charge, Liberty Arts, to take pictures on which the student could appear and publish them on its website or on the social networks or any other medium (posters, etc.) for advertising purposes or for the promotion of the organization or student, all this without any time or territory limitation.



9 – ETHICS AND WORKSHOP PRACTICE

In its teaching, Liberty Arts values the respect for the students and their learning pace. In the same way, Liberty Arts expects its students to respect their peers, the teacher and anyone else who is present in the place.

The respect for the environment and equipment is also required.

Liberty Arts reserves the right to terminate the courses of any person who breaches these ethical rules. In this case the person will be reimbursed according to the rules provided for the termination of the course by the student.



10 – CANCELLATION OF COURSES BY LIBERTY ARTS

Liberty Arts reserves the right to postpone the start date of a course, limit the number of participants, replace the teacher or cancel a course or workshop in particular due to the lack of a sufficient number of participants.

In this latter case, you will be, at your choice, integrated in another course whose schedule suits you or refunded according to the following provisions:

• If a course is canceled by Liberty Arts prior to the first scheduled lesson, the total amount paid will be refunded.
• In the event of cancellation after the start of the courses, an amount equivalent to the value of the carried out lessons will be deducted from the amount reimbursed for each given course.



11 – TERMINATION OF THE COURSE BY THE STUDENT

Upon receipt of a termination request, the following terms apply: regular course of 5 or more lessons.

In accordance with the Consumer Protection Act: upon receipt of the termination form, Liberty Arts will deduct from the amount to be refunded:

• the amount equivalent to the value of the lessons carried out, regardless of whether the student was present or not, as well as 10% of the price of the remaining lessons.
• the amount will be refunded within 30 days from the receipt of the termination notice.
